Before
you set out to have your papers served, please
consider the following:
In order to have a document
properly served, the person
serving your papers must be at least 18 years of age, and
must not be a party to (involved in) the action (the case).
This person can be
anyone meeting the above
requirements and does not have to be a process
server, per se.
However, just as
you wouldn't go to a cousin for an uncle's advice,
using a
process server that is familiar with your type of
legal matter may not
only save you time and money, but may help ensure your documents
are served correctly; the first time
around.
Important: Improperly
serving your papers may cause your case to be dismissed
(tossed out of court) if challenged by the other side in
what's called a Traverse Hearing or by Motion To Dismiss
based on a
CPLR 308(1); 308(2)
(due-diligence); or
CPLR 308(4)
(nail & mail) technicality, among others.

What to look for in a professional process server:
FIRST:
Make sure that the Process Server is Licensed by the
NYC
Department of Consumer Affairs (DCA).
SECOND:
If meeting with the process server, request that they bring
their Process Server License Pocket ID Card
and confirm that
it
has not expired.
THIRD:
Ask the process server if he/she has had any complaints
filed
against them with DCA. This will
make it known that
you are aware
of their licensing
requirements and your complaining abilities.*
FOURTH:
Be sure you select, from our available categories, the
process
server that comes closest to your type of
case.
Then, be sure to
confirm that they have
experience
serving papers in legal
proceedings
(cases) similar to yours.
